Arbor Ridge Home Owners Association Meeting May 24th 2010

Attendance: Mike F. Dave C. Tom W. Sunil L. John M. and Lynda D. from TMG

Homeowner’s Input:
Brian Smith Homeowner near 174th and Laidlaw, Spoke about the graffiti issue and that kids are playing in the wetland area near the bridge during school hours. Kids playing with “airsoft guns” shooting at each other.

Todd from Tuscon St. addressed the board about the large No Solicitation sign installed on there front door that is clearly seen from the street. The homeowner was explaining the issue when he was told that we will cover his and other issues at the special signage meeting in June.

Desert Canyon – landscaping issues from homeowners complaining that the front yard bushes are getting hacked up by the landscapers and the homeowners want more control over how the landscaping is done. And the automatic watering system is over watering the yards and homeowners want more control over how much watering is done.

Any announcement on bark dusting this year? Homeowners want notification on when the barkdust will be replaced. Suggestion was to have sandwich boards out that look like the community meeting sandwich boards that the HOA uses.

Meeting called to order at 7:36pm

Hearing on 17310 Lapaloma Dr. – Tree removed and replaced. Homeowner is asking that all the fees be dropped. The homeowner seemed to be merging two issues into one. There was a landscaping issue and a street tree issue. The tree has been replaced but this took several months to happen. Also the landscaping issue has been going on for three years. The board agreed to a landscaping plan that is to be submitted in two weeks from the date of this meeting. There was no discussion by the board to repeal any fines that have accrued over the three years of non-compliance.

4. Shrub pruning and replacement – Mary requests that a document for the description of how, what, where, shrubs are to be and replacement rules etc.

Motion on fence washing and seal coating –

Max budget of 3,900 on Fence washing and a Max budget of 4,500 on the seal coating.

Management report –

In summary for the management report all fines assessed on each issue were held and other warnings were noted. If the issue was covering signage, those issues will be worked out after the special meeting that will discuss issues of signage on the property. Please see the attached Management report for details on each issue.

Delinquency report –

Discussion over the properties most delinquent that have been forwarded to Smith and Greaves have yielded some conclusions.

16746 NW Oak Creek Drive  and 4316 NW Moon Valley Terrace the owner has moved to New Jersey and it to peruse this issue will be very costly. The attorneys recommend closing this issue. $5802.87 outstanding

Repairs and Maintenance –

Bark Dust map was dropped off at Tom W. house – John M. Scanned and mailed the map out to the board.

Lynda will speak to John at Showplace about bark dust notifications.

Call to Order: 7:05pm

Treasurer’s Report: Sunil L. will email an overview of the Columbia Bank information for the board at a later date. For minutes purposes the basics are that the majority of banking will remain with US Bank. What will be moved to Columbia will be the reserve funds so they can have a .8% return on those funds in the form of a money market.

Fines have been waived due to no prior history at this address.

Basketball Hoop should not be stored on the sidewalk – Basketball hoop and stand have been removed – no action taken

For Rent sign has been noted at address – This issue has been tabled for further review by the board. Signage that appears at any home will be noted during this time.

White rocks in the front of the home have been thinning out and the board will ask that the rocks be properly maintained (Fill in the bare spots) Fines waived.

There is no Rule or Regulation on Number of Planting in a yard, nor that they should be replaced if once there. The only Exception should be the Street Tree. No action required

Hose was found to be in violation of neat and tidiness, upon board review it was felt that the picture of the hose was in an acceptable condition – No action taken

Commercial truck/van was parked in the driveway – CC&Rs are very specific about commercial vehicles parked in the community. After much discussion by the board it was felt that the preference was to have the vehicle parked in the garage and if the vehicle could not fit then the driveway would be acceptable. Wave fine if these conditions are met.

Home Owner should go to their Title company and request copies of the Signed CCR’s when he did title if he does not have them. There is nothing in the CCR’s stating that patio furniture is not allowed. In checking the photos and a drive by it is not junky or out of place. It would be more appropriate if fully assembled. There is plenty of Patio furniture on front porches in the neighborhood as H/O has shown. – Cathy P. motioned that the swing top should be removed and stored off the porch. Compliance will result in waiving the current fines. This motion was seconded and approved by the board

U: 16820 NW Tucson

Hose was found to be in violation of neat and tidiness, upon board review it was felt that the picture of the hose was in an acceptable condition – No action taken

V: 4516 NW Bobcat

Multiple disturbances at this location – No issue for the board. TMG has been in contact with the Homeowner

W: 16853 NW Arizona

Trim on and around garage door was painted black by the previous owner – New owner has submitted an ARC on the issue – No further action will be required.

Financial: Not covered this evening other than Sunil’s Columbia bank information

Repairs & Maintenance: Showplace has an estimate of $14,300 for installation and placement of new bark dust in the cottage collection and $4,300 for new bark dust in the common areas. In discussion about this service it was determined that a Statement of work should be submitted to John at Showplace. Cathy P. proposed a motion to create a statement of work with pictures and once this is submitted and agreed upon then Showplace may begin this work. This motion was seconded and passed by the board. Further Cathy P. and Aditya K. will liaise with John at Showplace to go over the statement of work.

*Lynda – The board would like to get a full diagram of the grounds covered by the cottage collection and the Master association so the board knows where the bark dust areas are located.

Sidewalk repairs for the cottage collection will be for 29 homes is $3,600 – Cathy P. motioned to approve this repair and it was seconded – Board approves this motion.

Unfinished Business: Sprinklers have been checked and batteries have been replaced, they are ready for the season.

Solar Panel installation – discussion about the panel placement and upkeep

New Business: Meeting length was discussed and TMG will start charging if meeting exceed 1.5hrs. Notably a timer was requested to help keep meeting time to a reasonable level.

It was agreed that repair of the white rail fence at the corner of 174th and Laidlaw should be undertaken as soon as possible.  Cathy is to get an estimate of the cost to replace from spare parts and report to the Board.

Homeowner Input –

16642 NW Tucson St. Homeowner is upset that he has received 9 friendly reminders in 2009 would like the reminders to stop. Homeowner is waiting till spring to install the new landscaping.

4398 NW Palmbrook Dr. Homeowner is not understanding the $174 fine, And there were several questions about the reserve fund. Mike was asked to put an explanation on the website.

16599 Oak Creek Dr. Part of the meeting this evening, the homeowners were asked to wait till the meeting.

4656 NW Union Hills Dr. $75 in fines for garbage cans being left out. Lynda D was asked to research the homeowners past fines.

17310 NW Lapaloma Dr. Issue closed – Tree has been replaced.

16853 NW Arizona Dr. New homeowner is asking to be able to leave Black trim paint around the garage. Homeowner has been given a notice to correct but they bought the home in that condition.

Treasurer’s Report: Sunil and Tom are looking into a different bank for the HOA Accounts – They will present more information at the next board meeting or over email

Committee Reports:

Social Committee: Community Garage Sale date June 5th, Ice cream social will be on August 21st and Cathy P. is still waiting on information about the July 4th celebration.

Landscape Committee: From a email forwarded from Lynda Dulong – Now that Spring is officiallly here Carolyn Benedict and I took a walk of the common areas and this is what we found the needs attention.

1. Missing shrub on the east side of single fir, east edge of the development along West Union, just east of Oak Creek Dr.

2. No tree, only a stump, midway between Oak Creek and Palmbrook, along West Union.

3. Pruning of shrubs needs to be done. ( John, I can walk with you to point out the exact shrubs).

4. Lawn needs moss treatment.

5. One stump/no tree just west of Palmbrook along West Union.

6. Dead shrub next to fir tree, midway between Palmbrook and Laidlaw, along West Union. Plus there is a tree stump in the sameflower bed. Looks like it needs an evergreen like the others along West Union.

7. Orange flag in flower bed. along West Union, that has two fir trees ans is across sidewalk from Verizon power boxes.

8. Arbor Ridge momument on the east side of Laidlaw looks like it needs a few more flowers. When looking directly at the momument, to the left in front the 3 laurel buses, there is an empty space that needs something. Flowers like are already there would be nice.

9. We question the type of evergreen that has been planted as a replacement, just west of Laidlas along West Union. It looks like a “christmas tree and does not match any other evergreens in the area. We do not believe it is the right tree for the area. We aresuggesting that it be replaced by one more like the type that is all along the entire development on West Union.

10. Just to the east of the above tree is a spot where a shrub that matches the one on the other side is needed.

11. Arbovita is needed in the walkway that is located between 174th and Diamondback.

12. Arbovita is missing on the walkway that has the new black chain link fence that begins at the east side of 174/Laidlaw.

13. Has tree & shrub fertilization begun? If not when will that occur?

14. Wetland area just west of Laidlaw where the Beavers have been working. WE have a question. There appears to have been some “human” cutting of one tree next to the chain link fence. John, can you verify. Also, there is a large pile of tree material , very obvious, out in the middel area. Was that done by Beavers or by humans?

15. This one is directed to the board for directioin. In the same area as mentioned above, we found some “human” trach. I will becontacting the Clean Water people for direction. We believe that the “human” trash should be removed. We will let you know what the Clean Water people say.

16. Graffitti found on the walk way between 174th and Diamond back on the white rail fence.

17. Graffitti found on the end fence post, at the enterance to the walk way from 174/Laidlaw where the black chain link has replaced the white rail fence.

18. Rock break down is occurring along the westland walk way on the east part of the subdivision behind the cottage collectioni.Does this need to be assessed by a structural engineer? This is not new, but is continuing to occur with more large rocks. Our concern is that this type of errosion might compromise the integrity of the wall. Mike, while we were walking today we found a woman walking her two very large dogs, off leash, down in the wet lands behind your home. We spoke to here about the fact that the area was not open to people and animals. She was very rude and actually let her dogs come running up to us. They were very wet and dirty, which appeared to verify that they were down in the water. Not sure what you might want to do. If nothing else, she had her dogs off leash. She told us it was none of our business and acted very defiant. Not sure what one might be able to do. We will walk the cottage collection in two weeks and report our findings then. Consider this as the first report from the Landscape committee for this year. John or Mike, please feel free to contact me for further clarification on any of this report.

4611 Sidewinder: Suggestion to remove the fines – Dave C. motioned to remove the fines and this motion was seconded.

17190 NW Elkrun: – Basketball Hoop has been removed

4382 NW Diamondback Dr. – Rent sign in front yard, Homeowner wants this allowance and the fines waved. This issue started a long discussion about signage other than a For Sale sign or a Political sign. A motion to table all signage decisions till the board cam make a determination on for Rent signs, Beware of Dog, etc. All Property signs will be noted during this time until the HOA can form a resolution about signs on a homeowner’s property. Motion by John M. and seconded.

17012 NW Oak Creek Dr. – White rocks in the front yard. Homeowner is stated that the rocks have been there for years and the yard is kept well. There is no stated limit on ground cover. Discussion on this issue was that the rocks are uneven and spotty in there coverage. *Secretary doesn’t recall if there was a determination on the fines assessed.

16599 NW Oak Creek Dr. – For Rent sign in the yard. – This issue is tabled till the Board can make a determination on signage in the yard.

17310 Lapaloma Dr. – Street Tree that was missing, $300 fine – This issue will be researched and discussed in the next meeting.

Motion by Dave C. That to toll all fines for alteration to homes color. And Table all Compliance till further notice. Motion seconded.

Meeting was running late and Mike F. called for a close to this meeting due to all remaining agenda items. It was determined that there will be a continued open meeting Monday April 5th to revisit the Administrative items and Homeowner input.

    Arbor Ridge Home Owners Association Meeting – January 25th 2010

    Attendance

    Homeowner Input

    Homeowner had a question about a loud neighbor and what to do about the neighbors loud parties that run into the night. The Association recommended that the Washington County Sheriff’s non-emergency line to deal with the situation. The homeowner in addition should contact TMG so a letter can be sent to the homeowner in violation.

    President’s Report

    Playground equipment to be added to George Otten Park has not been added yet so Tualitin Hills Parks and Recreation must be waiting till spring to install the new equipment. THPRD have installed a sign noting the changes to the park. More people are signing up to the Arbor Ridge Web site.

    Treasurer’s Report

    Waiting on year end financial to come in and also looking to get some outside financial advice on changing the way the association is banking. Lynda will contact a financial adviser to attend a meeting. A discrepancy in water billing was reported by the President that it appears a charge may have been applied to the Main Association that should have been applied to the Cottage Landscape. TMG will look into it.

    Neighborhood Watch:  John M. has checked the email inbox and has replied to the 2 emails in the inbox but nothing has been replied to.

    Social Committee:  The Holiday decorating contest went well this year and Cathy P. had a great time with it. The board suggested some changes and a expansion of the festivities for this year and also suggested that Cathy P. start planning it out now so the word will get out earlier this year. And some other suggestions about having a parade for the 4th of July and other events.

    Newsletter:  Mike asked for a volunteer to start up with the newsletter so John M. will start doing the Newsletter this year.

    Management Report

    4457 NW Legend Trail Place – Homeowner has responded to the violation and is requesting that the removal of the fine of $48.74 – After a board discussion a motion was raised to keep the fine in place and this motion was seconded and approved by the remainder of the board

    17190 NW Elk Run Drive – Homeowner had a For Sale sign in the front window of the home and given a $75 fine for the violation. Homeowner requested that the fine be removed due to the homeowner being on vacation. Motion was raised to keep the fine in place and this motion was seconded – Board voted to keep the fine in place.

    4312 Diamondback Drive – Homeowner has been given a $75 fine for lawn maintenance issues homeowner is in attendance and discussed the situation to the board. Motion to wave the fine was raised by C.P. and seconded – board passes the motion to wave the $75 fine.

    16687 NW Tucson St. – Homeowner would like the $75 fine removed for lawn maintenance violation. In a letter of response the homeowner explains that his lawn is now different than the common area next to his property. D.C. motioned that the fine remain and this was seconded and the board passed this motion.

    17162 NW Mesa View Lane – Homeowner replied to the board that they would like the $75 fine removed since they have a contractor working on the lawn. But due to soil being mostly clay that this is delaying the results. S. L. motioned to keep the fine in place and C.P. seconded the motion. The board voted to keep the fine in place.

    16976 NW Mesa view Lane – Homeowner responded to the violation with information that the lawn is doing better and Tom W. confirmed that there has bee improvements on the property. After discussion C.P. made a motion that the board will wave the fine as long as there is no citations within the calendar year of 2010 and the motion was seconded and the board voted to waive the fine on the condition that if no other citations would be issued the fine will be waved.

    2. Compliance Report / Trash Cans

    Trash cans were back up to about 80 s/b 50 cans left out past Thursday morning. After discussion if the can tagging was working or not the board seemed to be thinking that the tagging was working as long as after the second time there was a letter sent to the homeowner. Hopefully the numbers will drop again soon. Violations were not given out during the holidays but that seemed to lead to a spike in left out cans. Currently notes on left out cans and after 2 notes a letter will be sent out that will be the ongoing process unless another change needs to be discussed.

    Financial

    1. Delinquency Report – Currently the delinquent homeowners are just adding late fees to there fees owed. No additions to the information provided in the report.

    2. Spectrum Year End Statement – Waiting for the independent auditor to hand in the report.

    Repairs and Maintenance

    1. Fence Update – Currently all fencing has been cleaned and or replaced.

    2. Monument Lights – The sensor has been checked out and should be working correctly. Cathy noted that the West side Monument the middle light seems to be out or very dim.

    3. Graffiti – All fence and wall graffiti has been removed – Cathy P.noted that there is still green paint on the sidewalk where the new wire fence was put in place. Also – graffiti is now on the Clean Water Signs which reside in the Wild Area between Laidlaw and 174th. They can be purchased from Clean Water dept at $8.00 a piece instead of having the graffiti cleaned off.

    Unfinished Business

    Neighborhood walk with the board – tentatively looking at spring time as a good walk around time.

    Looking into having Tom include Moss/paint/and clutter around the home as a addition to his other duties as compliance officer.

    New Business

    4068 NW Klino Springs – $75 violation was charged to homeowner for yard maintenance. After discussion C.P. motioned to keep the fine in place, the motion was seconded and the board passed to keep the fine in place.

    Cathy P. recommended that the new trees that Showplace replaced should be marked with a ribbon so we can track that they survive this next year. TMG will follow up with Showplace
